These Terms of Service ("Terms") govern your access to and use of SaddleWorks ("Service"), provided by Chestnut Mare Systems LLC ("we," "us," or "our"), a Pennsylvania limited liability company. By accessing or using our Service, you agree to be bound by these Terms.
By creating an account, accessing, or using SaddleWorks, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
SaddleWorks is a business management platform designed for equine professionals including saddle fitters, farriers, equine bodyworkers, and equine dentists. The Service includes features for scheduling, invoicing, payment processing, client management, reporting, inventory management, and business analytics.
You must be at least 18 years old and capable of forming a binding contract to use this Service. By using SaddleWorks, you represent and warrant that you meet these requirements.
United States Only
Due to payment processing limitations, SaddleWorks is currently only available to users located in the United States. By using the Service, you confirm that you are located in and operate your business within the United States.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.
Important Subscription Information
We offer a 7-day free trial period. During the trial, you have full access to all features of SaddleWorks Essentials. A valid payment method is required to start your trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged the monthly subscription fee.
After your trial period, access to SaddleWorks requires a paid subscription at $69 per month ("Subscription Fee"). By subscribing, you authorize us to charge your payment method on a recurring monthly basis.
Your subscription will automatically renew each month on the anniversary of your subscription date unless you cancel before the renewal date. You will be charged the Subscription Fee at the beginning of each billing cycle.
Payment processing is handled through our secure payment infrastructure. By providing payment information, you authorize us to charge the payment method on file for all applicable fees.
You are responsible for maintaining valid payment information. If your payment method fails, we will attempt to notify you and may suspend your account until payment is received.
If your payment fails, your account will enter a grace period during which you can update your payment method. If payment is not received within the grace period, your account will be suspended and may be terminated.
All subscription fees are non-refundable. When you cancel your subscription, you will retain access to the Service until the end of your current billing period, but no refund will be issued for the remaining days in that period.
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will not be charged for subsequent billing periods after cancellation.
We reserve the right to modify our pricing. Any price changes will be communicated to you at least 30 days in advance and will take effect on your next billing cycle. Your continued use of the Service after a price change constitutes acceptance of the new price.
When you accept payments from your clients through SaddleWorks, payment processing fees of 3.2% + $0.30 per transaction apply. These fees are separate from your subscription fee and are automatically deducted from each payment received. Payment processing is subject to additional terms and conditions from our payment processor.
You agree to use SaddleWorks only for lawful purposes and in accordance with these Terms. You agree NOT to:
Client Consent Requirement
You are required to obtain explicit consent from your clients before enrolling them to receive SMS text message notifications through SaddleWorks. This includes appointment reminders, invoice notifications, and any other text message communications.
By using the SMS notification features of SaddleWorks, you agree to:
You are solely responsible for ensuring compliance with all applicable laws regarding SMS communications to your clients. Chestnut Mare Systems LLC is not liable for any claims, damages, or penalties arising from your failure to obtain proper consent or comply with applicable regulations.
SaddleWorks, including all software, text, graphics, logos, and other content, is owned by Chestnut Mare Systems LLC and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes only.
You retain all ownership rights to the data you input, upload, or generate through the Service ("Your Data"). By using the Service, you grant us a limited license to use Your Data solely for the purpose of providing and improving the Service.
If you provide us with any feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation or compensation to you.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
We implement industry-standard security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security of your data.
While your account is active, we will retain your data to provide the Service.
You may request deletion of your account and data at any time by contacting us at [email protected]. Upon receiving a deletion request, we will delete your data within 30 days, except as required for legal, tax, or regulatory purposes.
If your account is suspended or terminated, your data will be retained for 90 days to allow for account reactivation. After 90 days, your data will be permanently deleted.

Important Legal Notice
The Service is provided "as is" and "as available" without warranties of any kind.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHESTNUT MARE SYSTEMS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You are solely responsible for your use of the Service and for any data you input or generate. We recommend maintaining regular backups of your important data.
You agree to indemnify, defend, and hold harmless Chestnut Mare Systems LLC, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. Arbitration shall take place in Pennsylvania.
Either party may seek injunctive or equitable relief in court to protect intellectual property rights or confidential information.
You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action or class-wide arbitration.
You may terminate your account at any time by canceling your subscription through your account settings or by contacting us.
We reserve the right to suspend or terminate your account at any time if:
Upon termination, your right to access and use the Service will immediately cease. We will retain your data for 90 days to allow for potential account reactivation, after which your data will be permanently deleted (except as required by law).
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chestnut Mare Systems LLC regarding the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet service provider failures.
